The modern justice system has become incredibly complex. They are governed by numerous rules, procedures and laws. In addition, they have to work under difficult circumstance with severely restricted resources. As a result, most courts have long back logs of cases waiting to be heard. Meanwhile the law enforcement agencies are expected to maintain law and order. To this end they make thousands of arrests each year and all of these accused simply cannot be kept incarcerated. Any arrest should be seen in a very serious light. It can lead to a conviction and a life long criminal record. It can result in very hefty fines or even imprisonment. The accused will also have to pledge fixed assets in order to secure the loan and he will have to sign a very strict contract that will specify the conditions of the loan.

Clients of bondsmen are often shocked when they finally comprehend the implications of the contract that they signed. When they initially signed the document they were severely stressed and wanted nothing but to be released immediately and bondsmen know this. That is why it is best to leave all dealings related to the loan in the hands of the appointed lawyer.

Dishonouring the conditions of release can have extremely serious consequences. Not only will the individual be arrested once more, but he may be charged with further criminal offences. He will also forfeit the entire amount initially paid as surety and if he is granted a second change, he may have to negotiate yet another loan from a bondsman.

There are many critics of the bail system. The fact remains, however, that every accused has to be viewed as innocent until proven guilty. It is neither fair not practical to keep all arrested people in jail until their cases are heard.
